اسلام آباد: لاہور ہائی کورٹ کے جسٹس محسن اختر کیانی نے اپنے عہدے سے استعفیٰ دے دیا ہے اور اپنا استعفیٰ صدرِ مملکت کو ارسال کر دیا ہے۔ 28 اکتوبر 2026 کو تحریر کیے گئے استعفے میں انہوں نے ذاتی وجوہات، حالیہ سرجری کے بعد صحت کے مسائل اور عدالتی نظام کی موجودہ صورتحال پر اپنے تحفظات کو فیصلے کی وجوہات قرار دیا ہے۔
صدرِ مملکت کے نام اپنے خط میں جسٹس محسن اختر کیانی نے کہا کہ اسلام آباد ہائی کورٹ اور لاہور ہائی کورٹ میں خدمات انجام دینا ان کے لیے اعزاز کی بات رہی۔ اپنے عدالتی دور میں انہوں نے مختلف نوعیت کے 23 ہزار سے زائد مقدمات نمٹائے اور آئین کی بالادستی، بنیادی حقوق کے تحفظ اور بلاخوف و رعایت انصاف کی فراہمی کے لیے کام کیا۔
انہوں نے اپنے استعفے میں 26ویں اور 27ویں آئینی ترامیم پر تحفظات کا اظہار کرتے ہوئے کہا کہ ان تبدیلیوں نے ہائی کورٹس کی آزادی اور ادارہ جاتی خودمختاری کو متاثر کیا ہے۔ ان کے مطابق عدالتی اداروں پر انتظامیہ کا بڑھتا ہوا کنٹرول، بالخصوص ججوں کی تقرری اور تبادلوں کے معاملات میں مداخلت، عدلیہ کی آزادی اور عدالتی عمل کی شفافیت پر عوامی اعتماد کو نقصان پہنچا رہی ہے۔
جسٹس محسن اختر کیانی نے عام سائلین کی مشکلات کا بھی ذکر کرتے ہوئے کہا کہ انصاف کے نظام میں بنیادی اہمیت رکھنے والے عام شہریوں کی ضروریات کو اکثر نظرانداز کیا جاتا ہے، جس کے باعث انصاف کے حصول میں مشکلات بڑھ رہی ہیں۔
انہوں نے خط میں لکھا کہ موجودہ حالات میں ان کا ضمیر انہیں بینچ پر مزید کام جاری رکھنے کی اجازت نہیں دیتا، اس لیے انہوں نے عدالتی منصب چھوڑ کر دوبارہ وکالت کے شعبے سے وابستہ ہونے کا فیصلہ کیا ہے، جہاں وہ عوام کے حقوق کے تحفظ اور قانونی آگاہی کے فروغ کے لیے کام جاری رکھیں گے۔
جسٹس محسن اختر کیانی رواں سال اپریل میں جوڈیشل کمیشن آف پاکستان کی سفارش پر اسلام آباد ہائی کورٹ سے لاہور ہائی کورٹ منتقل ہوئے تھے۔ ان کے تبادلے کی منظوری اس وقت کے قائم مقام صدر یوسف رضا گیلانی نے دی تھی۔ لاہور ہائی کورٹ منتقلی کے بعد ان کی سینیارٹی تبدیل ہوئی اور وہ نئی فہرست میں 12ویں نمبر پر آگئے تھے۔
حالیہ عدالتی روسٹر کے تحت انہیں لاہور ہائی کورٹ کے راولپنڈی بینچ میں سنگل بینچ کی ذمہ داری سونپی گئی تھی۔
جسٹس محسن اختر کیانی اسلام آباد ہائی کورٹ کے ان چھ ججوں میں بھی شامل تھے جنہوں نے مارچ 2024 میں سپریم جوڈیشل کونسل کو خط لکھ کر عدالتی امور میں مبینہ مداخلت اور دباؤ سے متعلق تحفظات کا اظہار کیا تھا۔
اپنے استعفے کے اختتام پر انہوں نے اپنے اساتذہ، ساتھی ججوں اور اہل خانہ کا شکریہ ادا کیا اور کہا کہ عدالتی خدمات کے دوران ان کی رہنمائی اور حمایت ان کے لیے باعثِ تقویت رہی۔

Subject: Resignation from the Office of Judge, Lahore High Court.
Honourable President,
I, Justice Mohsin Akhtar Kayani, hereby tender my resignation from the office of Judge of the Lahore High Court for personal reasons, including health concerns following my recent surgery, and for the reasons of conscience set out below.
It has been my privilege to serve at the Islamabad High Court and the Lahore High Court. These years of judicial service remain among the most meaningful and fulfilling of my life. During my tenure, I have disposed of more than 23,000 cases of various categories, endeavouring always to uphold the Constitution, safeguard fundamental rights, and administer justice without fear or favour.
However, in my considered view, the changes introduced through the Twenty-sixth and Twenty-seventh Constitutional Amendments have compromised the independence and institutional integrity of the High Courts. I have witnessed what I regard as the executive’s growing control over judicial institutions, extending to the appointment and transfer of judges. Such interference has, in my assessment, seriously eroded public confidence in judicial independence and the fairness of the judicial process.
Of particular concern is the plight of the ordinary litigant, who is the principal stakeholder in the justice system, yet whose suffering continues to deepen. The needs of those seeking justice have too often been neglected, while other actors have become the beneficiaries of a system intended to serve them.
In these circumstances, my conscience does not permit me to continue on the Bench. This is a painful decision, but it reflects my conviction that judicial office must remain inseparable from independence, fidelity to the Constitution, and the protection of human dignity.
I, therefore, consider that the time has come for me to lay down my robes and return to legal practice, through which I intend to continue serving the people, protecting their rights, and promoting legal awareness.
Finally, I express my gratitude to my teachers, fellow judges, and family members for their guidance and steadfast support, including during the deliberations that led to this decision.
